Motor Vehicle Accidents: Unsafe Highway Design

Case Study: 

  • Mr. Roda represented a driver who was terribly injured while making a left turn into a market where the break in the road’s center lane showed the turn should be made, when a car exceeding the speed limit in the oncoming, opposite lane of traffic came over a hill and hit the car making the left turn.
  • Suit was brought against both the driver of the speeding car, and the Commonwealth of Pennsylvania for placing the break in the highway’s center line too close to the hill, without the sight distance necessary for a safe left turn.
  • Both the Commonwealth and the speeding driver were found negligent, and the jury returned a verdict for the injured driver that was a record amount for that court.
